Terms of Service
Please read these Terms of Service ("Terms") carefully before using Gazenest. By installing the extension or accessing your dashboard, you agree to be bound by these Terms.
1. Service Description
Gazenest is a personal-insights and digital-wellbeing product for YouTube users. The browser extension reads the metadata of YouTube videos that you watch in your own logged-in session and the web dashboard turns it into your own viewing-time reports, focus sessions, and behavioural insights (Focus Score, Clarity Score, Diversity Score).
Gazenest is not affiliated with, endorsed by, or sponsored by Google or YouTube. YouTube is a trademark of Google LLC.
2. Eligibility
You must be at least 15 years old to use Gazenest (the digital-consent age in France under GDPR Article 8 and the Loi Informatique et Libertes). If you are between 15 and 18, you must have permission from a parent or legal guardian. We do not knowingly accept users from the United States who are under 13 (COPPA).
3. Accounts
- A valid email address is required to create an account.
- You are responsible for maintaining the confidentiality of your licence key.
- One licence key per person (except Family plans, which allow up to 5 accounts).
- You are responsible for all activity under your account.
4. Subscription and Billing
- Gazenest offers four paid plans: Solo, Plus, Family, and Pro.
- All payments are processed by Lemon Squeezy, LLC (Merchant of Record).
- Subscriptions renew automatically unless cancelled before the renewal date.
- You may cancel at any time from the Merchant-of-Record customer portal or from your Gazenest dashboard; access continues until the end of the paid period.
- Refunds are governed by our Refund Policy and applicable consumer law.
5. How Gazenest Interacts with YouTube
To be fully transparent about the boundaries of the service:
- Gazenest's backend uses the public YouTube oEmbed endpoint (youtube.com), the YouTube Data API (googleapis.com,
channels.list) and YouTube's public CDN (googleusercontent.com / i.ytimg.com) solely to resolve the public handle, avatar URL, and avatar image bytes of channels you have personally watched. No other channel metadata is requested or stored, and no data is collected about anyone other than the account holder. - Gazenest does not crawl YouTube, does not build any dataset about creators or other users, and does not aggregate data across accounts.
- Gazenest does not automate any action on YouTube (no auto-play, auto-click, auto-subscribe, auto-comment).
- Gazenest does not delete entries from your YouTube watch history or perform any write operations on your YouTube account.
- To import your past YouTube history into Gazenest, the extension uses Fast Import, which reads your watch history from your own logged-in YouTube session in your browser; you must explicitly acknowledge the relevant warning before using it. See How Fast Import Works for the full step-by-step.
5 bis. Your representations when you use Fast Import
By clicking through the Fast Import acknowledgement, you confirm that:
- The YouTube account whose history is being read is your own personal account, and you are signed into it in your own browser.
- You have the legal right to read and import that history (because it is data about you).
- You are not using Fast Import to access, copy, or import data belonging to anyone else.
- You understand that the request to YouTube happens from your own browser, with your own session, and that Gazenest's server is not in the middle of that request.
A record of each acknowledgement (timestamp, encrypted IP, browser, version of the warning text you read) is kept on your account to evidence this consent.
6. Acceptable Use
Permitted Use
- Track your own personal YouTube viewing habits.
- View and export your behavioural scores and analytics.
- Use Intent Mode to set goals before viewing sessions.
- Manage your account, devices, and subscription.
- Share access with household members on a Family plan.
Prohibited Use
Account abuse:
- Sharing your licence key with people outside your household.
- Creating multiple accounts to bypass device or plan limits.
- Providing false information during registration.
- Using fraudulent payment methods.
- Reselling, sublicensing, or redistributing access to the service.
Technical abuse:
- Reverse-engineering, decompiling, or disassembling the extension or API.
- Attempting to access or extract data belonging to other users.
- Sending automated requests that exceed reasonable usage or disrupt the service.
- Exploiting bugs or vulnerabilities (please report them responsibly via the contact form).
- Circumventing rate limits, device limits, or plan feature restrictions.
Legal:
- Using Gazenest in any way that violates YouTube's Terms of Service.
- Using the service to facilitate illegal activity.
- Attempting to collect data about other users without their consent.
Responsible Disclosure
If you discover a security vulnerability, please report it via the contact form. Do not publicly disclose it until we have had a reasonable opportunity to address it.
Enforcement
Violations of this section may result in a warning, temporary suspension, or permanent termination, depending on severity. We reserve the right to take immediate action without prior notice to protect the service or other users.
7. Intellectual Property
All content, trademarks, code, and design of Gazenest are the property of the publisher. YouTube is a trademark of Google LLC. Gazenest is not affiliated with, endorsed by, or sponsored by Google.
8. Privacy and Data Processing
Your use of Gazenest is governed by our Privacy Policy, which is incorporated into these Terms by reference. Professional / business users may additionally request our Data Processing Agreement.
9. Availability
We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, apply updates, or suspend access for security reasons without prior notice.
10. Disclaimer
Gazenest is provided "as is" without warranty of any kind, express or implied. We do not warrant that the service will be error-free or that results will meet your specific requirements. The Focus, Clarity, and Diversity scores are informational tools, not medical or psychological diagnoses.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Gazenest shall not be liable for any indirect, incidental, or consequential damages. Our total aggregate liability shall not exceed the amount you paid in the 12 months preceding the claim. This clause does not limit your statutory rights as a consumer.
12. Termination
You may delete your account at any time from your dashboard. When you do, your subscription is cancelled at the billing provider so no further charges are issued. You retain full access until the end of the period you already paid for, and your data is permanently deleted 30 days after the deletion request. You can cancel the deletion at any time during that window from your dashboard.
We reserve the right to suspend or terminate accounts that violate these Terms, with or without notice.
12.1 Retention offers (fair-use)
We may offer eligible users a one-time retention benefit (for example, a 30-day billing pause) when they attempt to delete their account. Each user is entitled to at most one such offer per lifetime. Eligibility is determined by automated rules including account tenure, active subscription status, real product usage, and prior receipt of a retention benefit. We reserve the right to revoke an offer and/or suspend an account where we detect abuse, including but not limited to: cancel-and-resubscribe rotations to harvest repeated offers, multiple-account farming, or evading the lifetime limit via secondary accounts.
13. Governing Law
These Terms are governed by French law. Any disputes shall be subject to the exclusive jurisdiction of the courts of France, without prejudice to your statutory rights as a consumer.
14. Changes to These Terms
We will notify registered users by email at least 15 days before any material changes take effect. Continued use after the effective date constitutes acceptance.
